Telecom Lease Renewal: Know Your Options

Understanding your telecom lease renewal can help you make the right decision for your farm and your future income. Explore what happens when a lease comes up for renewal and the options available to you.

What Does a Telecom Lease Renewal Mean for Your Farm?

For many farmers across the UK, having a mobile mast or other telecommunications equipment on their land has provided a valuable and reliable source of additional income.

However, if your telecom lease is approaching the end of its term, you may find that renewing the agreement is very different from when you first signed it.

The telecom industry has changed significantly in recent years. Renewing a lease can involve lengthy negotiations, professional fees and uncertainty over future rental income.

If you have a telecom mast on your farm, it is important to understand these changes and consider your options before your current agreement comes to an end.

What Does a Telecom Lease Renewal Mean for Your Farm?

The Challenge of Telecom Lease Renewal

Renewing a telecom lease is no longer always a straightforward process.

Farmers can find themselves dealing with:

  • Lengthy negotiations with telecom companies
  • Legal and professional fees
  • Additional paperwork and administration
  • Uncertainty over future rental income
  • The possibility of receiving less rent under a new agreement

For farmers who are already busy running their businesses, dealing with a complicated lease renewal can take valuable time away from the farm.

There is also no guarantee that a new agreement will provide the same level of income as your existing lease.

Additional measures around valuation were introduced under the Product Security and Telecommunications Infrastructure (PSTI) Act 2024 which have been implemented as of April 2026, meaning all valuations in England & Wales must fall under Code parameters with no recourse to the Landlord and Tenant Act (1954).

How Has the Law Changed?

One of the main reasons the telecom lease market has changed is the introduction of the Electronic Communications Code (ECC) in 2017 as part of the Digital Economy Act.

The ECC changed the way telecom companies and landowners negotiate agreements and determine rents for telecom sites.

Under the current rules, the value of the land itself plays a greater role in assessing rent, rather than the commercial value that the telecom site may have to the operator.

As a result, some telecom sites can be worth less when their leases are renewed than they were under agreements signed many years ago.

The ECC also gives telecom operators greater rights relating to the installation, maintenance and upgrading of their equipment.

Where an agreement cannot be reached between the operator and landowner, there are circumstances where the operator can apply to the Upper Tribunal to have terms imposed.

What Could This Mean for Your Farm?

If you signed a 10 or 15 year telecom lease before 2017, your agreement may now be approaching its end date.

When it is time to renew, you could be offered a lower annual rent than you currently receive. The renewal process may also involve professional costs and lengthy negotiations.

For this reason, it is worth understanding your position and looking at your options before your agreement expires.

An Alternative: Unlocking the Value of Your Telecom Lease

You do not necessarily have to wait for your telecom lease to expire before deciding what to do next.

One option is to consider unlocking the value of your lease through an upfront payment.

Telecom Infrastructure Partners (TIP) works with farmers and landowners to offer an alternative to continuing with a traditional telecom lease.

Depending on your individual circumstances, you could potentially:

  • Receive a substantial lump sum payment
  • Avoid the time and uncertainty associated with lease renewal
  • Reduce ongoing administration
  • Avoid potentially costly renewal negotiations
  • Secure the value of your telecom asset today

Rather than waiting for future rental payments, an upfront payment could give you access to capital now, providing greater certainty and flexibility.

Why Are Farmers Considering This Option?

Farming already comes with plenty of financial considerations.

Changing weather conditions, commodity prices, rising costs and investment decisions can all affect the future of a farm.

For some landowners, receiving the value of their telecom lease upfront can provide greater financial certainty and give them more control over how they use the money.

The capital could potentially be used to:

  • Invest in machinery and equipment
  • Improve farm buildings and infrastructure
  • Invest in land or diversification
  • Reduce borrowing
  • Support succession planning
  • Fund other farm investments or projects

Every farm is different, which is why it is important to understand the value of your individual telecom lease and the options available to you.

Making the Most of Your Telecom Asset

Your mobile mast may only occupy a small part of your land, but the lease attached to it can represent a significant financial asset.

With the telecom market having changed considerably since many existing agreements were signed, it makes sense to understand what your lease could be worth before making any decisions about its future.

You may decide that continuing to receive regular rental income is right for you.

Alternatively, you may find that receiving the value of your lease upfront gives you greater certainty and allows you to put the capital to work elsewhere.

The important thing is having the right information to make a decision that works for you, your family and your farm.

Is Your Telecom Lease Approaching Its End Date?

If your telecom lease or mobile mast lease is approaching its end date, now is a good time to explore your options.

Speaking to an experienced telecom specialist can help you understand:

  • What the Electronic Communications Code could mean for your agreement
  • How your future rental income could be affected
  • What your telecom lease could be worth today
  • Whether an upfront payment could be suitable for you

Looking at your options early gives you more time to make an informed decision about the future of your telecom asset.

“I would like to extend my thanks to Ashley Hardy for the assistance provided throughout the entire sales process. Without his help, I doubt if the sale would have gone through. We had many questions, and Ashley was always available to assist and act as a liaison between us and the legal teams, which greatly facilitated the sale’s completion.
